and Conditions
When you place an
order with Rkiv you agree to accept our Terms and Conditions of
business. The following
conditions apply to and are deemed to be incorporated in all
contracts
for the sale of services and products to you by Rkiv.
Rkiv reserves the right not to process any order for any
reason. In which case submitted payment and all materials will be
returned. Submission of any materials or items to Rkiv means you have
read,
understood and accept the terms of this disclaimer.
We handle your slides, photos and other items with the
greatest care
while they are in our control. We follow established procedures to make
certain that your items are safe and undamaged during our conversion
processes. However, we must include the following disclaimer:
Terms of Payment
When you place an order with Rkiv, you agree to pay for the services
before your order and conversion items are returned to you. You
acknowledge that the order you place is only an estimate and that the
final payment may be more or less that is determined by the actual
number and
type of conversion items submitted or services purchased. Typically,
payment is processed at the end of the conversion process or after
services
are rendered. Rkiv is not liable for any overdraft, other bank or
credit
fees you may accrue as a result of our charging your credit or debit
card. Any checks returned unpaid by your bank may be subject to a
charge of up to $20 to your account.
Limitations of Liability
Our compensation for lost or damaged items while in our
possession will not exceed the raw cost of the items or
$100,
whichever is less. We are not responsible nor liable for any
materials not in our possession. Items lost or
damaged while in
transit are the responsibility of the carrier's company and
are
subject to that company's terms. There is
no other expressed or implied warranty or liability,
and recovery for any incidental or consequential damage is excluded.
Copyrighted
Material
It is understood that the materials you
submit to Rkiv
are not copyrighted materials and therefore Rkiv is not subject to any
copyright
infringement claims made with respect to the duplication of any
items. If any copyrighted materials are submitted for
duplication, the buyer attests and warrants that by requesting Rkiv to
reproduce any copyrighted work, the purchaser owns the copyright
to the materials or will use the materials under the Fair Use section
(107) of the U.S. Copyright Code.
Compatibility of Media
Rkiv uses high quality CD and DVD media for the storage of your digital
files. We use DVD-R media which is compatible with practically all
recently manufactured DVD players and computers. It is the purchasers
responsibility to determine if your DVD player or computer is
compatible with DVD-R media. Rkiv checks every DVD we make and does not
offer refunds due to equipment/media incompatibilities. If any archival
media is found to be defective, it will be replaced free of charge if
returned within 90 days of shipment of the item.
Indemnity
By using our
services, you agree to indemnify and hold harmless Rkiv,
its consultants, and
employees from any and all claims and expenses, including
attorney's
fees, arising from your use of Rkiv services.
